Terms of Service & End-User License Agreement

Welcome to the mobile applications developed by NanaChinese ("Developer", "we", "us"). By downloading, accessing, or using any of our apps (including but not limited to Nana Pinyin Tutor and Nana Pinyin Converter), you agree to be bound by these Terms of Service and End-User License Agreement ("Terms"). If you do not agree, please do not use the Apps.

1. Acknowledgement

You and the Developer acknowledge that these Terms are concluded between you and the Developer only, and not with Apple Inc. ("Apple") or Google LLC. The Developer, not Apple or Google, is solely responsible for the Apps and the content thereof.

2. Scope of License

We grant you a non-transferable, non-exclusive license to use the App on any supported devices that you own or control, and as permitted by the Usage Rules set forth in the respective App Store Terms and Conditions. This App may be accessed and used by other accounts associated with the purchaser via features like Family Sharing or volume purchasing.

3. Subscriptions and Purchases

Our applications offer different business models depending on the specific app you download. The App Store page for each app will clearly indicate whether it is a Paid App (Upfront Purchase) or a Free App with In-App Purchases/Subscriptions.

3-1. Paid Applications (Upfront Download)

3-2. Terms for Auto-Renewable Subscriptions (If Applicable)

For apps offering a freemium model with subscriptions (e.g., Nana Pinyin Tutor):

  1. Payment will be charged to your app store account at confirmation of purchase.
  2. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  3. Your account will be charged for renewal within 24-hours prior to the end of the current period.
  4. You can manage and cancel subscriptions by going to your device's Account Settings after purchase.
  5. No cancellation of the current subscription is allowed during the active subscription period.

3-3. Terms for One-Time In-App Purchase (Lifetime)

For apps offering a "Lifetime" unlock option via In-App Purchase:

  1. Payment is a one-time upfront fee granting you permanent access to the App's premium features.
  2. Includes Updates: Your purchase includes all regular app updates, bug fixes, and feature improvements delivered through the App Store for that specific App.
  3. Definition of "Lifetime": "Lifetime" refers to the lifespan of this specific App. You will have access to the premium features for as long as we continue to support and maintain the App. It does not guarantee access to entirely new standalone apps or fundamentally different future services.
  4. Refunds are subject to the respective app store platform's refund policy.

3-4. Restoring Purchases

If you reinstall the App or switch to a new device (using the same store account), you can restore your Premium access or Lifetime purchase using the "Restore Purchases" button located in the App's Settings menu.

4. No Account Required & Data Retention

You can use our apps without creating an account. Your progress, settings, and conversion history are saved locally on your device. If you uninstall the App or change devices, your local data and learning progress may be permanently lost.

5. Maintenance and Support

The Developer is solely responsible for providing any maintenance and support services with respect to the App. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

6. Warranty and Disclaimer

The Apps, including features like AI Voice Scoring or Pinyin Polyphone Recognition, are provided on an "AS IS" basis. While we strive for accuracy, we do not guarantee that the pronunciation feedback or conversion results will be 100% error-free.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

7. Intellectual Property Rights

All content, algorithms, and designs within the Apps are the exclusive property of NanaChinese. You may use the outputs generated by the App (such as exported images, Pinyin texts, or PDFs) for your personal, educational, or teaching purposes. In the event of any third-party claim that the App infringes that third party’s intellectual property rights, the Developer, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.

8. Limitation of Liability

To the fullest extent permitted by law, NanaChinese shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Apps or reliance on their output.

9. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
